GENERAL: NZXR: Notice of Amendment to NZAX Listing Rules

NZX Market Supervision hereby gives notice of an amendment to the NZAX Listing Rules ("Rules").

This amendment relates to Rule 11.3.2, and deletes the words "Market Participants (as defined in the NZX Participant Rules)" from that Rule and inserts the word "Participants", so that the amended Rule 11.3.2 shall read as follows:

11.3.2 Every Issuer shall ensure that its registry functions are performed promptly and properly and shall indemnify Participants and persons having dealings with its registrar against any losses, costs or expenses incurred as a consequence of any failure in such performance of registry functions which is not fairly attributable to the fault of the person claiming indemnity (or his or her agent). This amendment relates to the introduction of NZX's new clearing and settlement system ("Settlement System") and will come into effect on the later of:

1. 14 September 2010; and 2. the date NZX notifies to the market on which the Settlement System will become operative (the "Go-Live Date").

As the Go-Live Date is dependant on the receipt of necessary regulatory approvals, NZX will advise the market of the Go-Live Date.
